Mohammed “Moe” Diab and Amy Rountree have pled guilty to Allied Wallet fraud charges.

Rountree’s guilty plea was entered at a hearing held on August 12th. Diab’s plea was entered at a hearing the following day.

Both Rountree and Diab have pled guilty to one count of conspiracy to commit bank fraud.

Sentencing for Rountree is scheduled for November 19th, 2024. Diab is scheduled to be sentenced a day later on November 20th.

Both defendants are facing a maximum 30 year prison sentence, $1 million fine or twice the amount gained.

In the original 2021 Allied Wallet indictments, the company was accused of generating over $150 million in processing fees.

Allied Wallet was a payment processor that provided financial services to scammers. Allied Wallet set up shell companies, through which financial institutions and card brands were tricked into providing services to dodgy clients.

Allied Wallet was owned by CEO Ahmad “Andy “Khawaja” (right), who remains a wanted fugitive.

As of June 2023, Khawaja is reported to be out on bail pending extradition proceedings in Lithuania.

Approached by BNS, Lithuania’s Prosecutor General’s Office has refused to provide any information regarding Khawaja’s extradition to the US, his current status or the investigations into his activities.

Diab and Rountree were Allied Wallet’s COO and VP of Operations respectively.

A fourth defendant, Thomas Wells, pled guilty in October 2021. Wells’ sentencing has repeatedly been pushed back since the original February 2022 date.

Wells was scheduled to be sentenced on June 5th, 2024. Since that date was set last November though, there have been no further updates.

Separately in 2019, Khawaja and Diab were indicted on charges pertaining to conspiracy to conceal conduit and excessive political campaign contributions.

Update 16th September 2024 – On September 13th three rescheduling notices were filed by the court:

  • Thomas Wells’ sentencing has been rescheduled for January 14th, 2025
  • Mohammed Diab’s sentencing has been rescheduled for December 19th, 2024
  • Amy Rountree’s sentencing has been rescheduled for December 13th, 2024

No reason for the rescheduling is provided in the notices.

 

Update 16th November 2024 – On November 8th the court advised the parties it intends to reject Mohammed Moe Diab’s plea agreement.

The court concludes that, based upon information presentently disclosed, a time served sentence is insufficient to achieve the goals of sentencing.

The parties have been directed to file supporting memorandums by November 22nd, “after which the Court will promptly resolve the matter”.

If the court does reject Diab’s plea agreement I’ll have a separate article up when the decision is made.
