Default entered against Matt Lloyd and MOBE related entities
Following a Motion for entry of clerk’s default by the FTC on February 1st, default has been entered against Matt Lloyd, MOBE and several MOBE related entities.
In total the court clerk entered default against ten MOBE defendants;
- Matt Lloyd (aka Matthew Lloyd McPhee);
- Mobe LTD;
- MobeProcessing;
- Transaction Management USA;
- MOBETraining;
- 9336-0311 Quebec Inc.;
- MOBE Pro Limited;
- MOBE Inc.;
- MOBE Online LTD; and
- Matt Lloyd Publishing Pty Ltd.
The recording of entry of default paves the way for the FTC to file for default judgement at a later date.
Regarding Matt Lloyd though, things might be a little complicated.
As of last July it was looking like Lloyd was heading towards a settlement with the FTC.
That was seven months ago however, and we haven’t had any updates since.
The FTC filed for a Motion of entry of clerk’s default against Lloyd on the basis that, as of February 1st, 2019, Lloyd had ‘failed to plead or otherwise defend this action‘.
It was on this same basis that the court clerk recorded an entry of default against Lloyd.
On February 6th, five days after default had been entered, Lloyd filed an answer to the FTC’s lawsuit.
I’m unclear on whether Lloyd’s answer after the fact has any bearing on the recorded entry of default.
With respect to Lloyd’s answer to the FTC’s complaint, most of it is denials – suggesting a settlement, at least for now, is off the table.
In particular Lloyd seems to have taken objection to the FTC’s characterization to the “education” MOBE provided.
Here are some examples;
(1) Matt Llord denies the statement “Defendants claim to have a “simple 21-step” money-making system that will show consumers how to quickly and easily make substantial income”, because it was explained clearly in 21 step system as well as in disclaimer that it requires work and effort.
It was also demonstrated that student success depends on their efforts.
(2) The remainder of paragraph 35 is denied due to the mischaracterisation of sales agents as they were coaches who teach useful material to students.
(3) The remained of paragraph 38 is denied due to the mischaracterisation of MOBE products as memberships, MOBE did not offer its programs as memberships, and these programs were educational.
(4) Matt Lloyd denies that MOBE programs were progressively tiered in a way that buyers have to pay for the program in full first before they join another coaching program.
All of these programs were different programs.
Also, there are many other ways to enter these programs rather than paying for them.
(5) Concerning paragraph 60 of the Complaint, Matt Lloyd denied due to the statement that was said: “no work or effort is required to make sale.”
It was statements [sic] at numerous places along with income disclaimers and agreements that it requires effort and work.
And so on and so forth.
Few thoughts;
In regulatory cases involving fraudulent MLM opportunities, courts have consistently ruled that what participants had to do to get paid wasn’t “work”.
Two prominent examples that come to mind are Zeek Rewards (selling bids) and TelexFree (selling VOIP packages).
Neither action was deemed “work that required effort”, sufficiently so to argue that both schemes were fraudulent in nature.
And so I think Matt Lloyd is going to have a hard time arguing selling MOBE’s “educational” courses was legitimate work, upon consideration of widespread losses among MOBE participants.
Also given said widespread losses, making an argument that MOBE’s “educational” courses were legitimate is also problematic.
The financial reality for the majority of MOBE members who undertook the courses speaks for itself.
As of February 13th there aren’t any further updates on the case docket after Lloyd’s February 6th filed answer. Stay tuned…
This what happen to us. From the very start, we only want from the bottom line to start.
My first coach told me just after step 6. Now you are done I will leave you to the next coach. I forgot his name—-. then the lesson was blocked. Until I have to pay again.
My next couch is Marlon Noqui. Then I start from him all the way to the 21 steep. Then nothing happening and still no money our side to make any income. Then that the time Mr. Noqui told us that we have to make it up there to the higher position to make obey.
We still did not see money coming and my coaching from him was very blurry how we can make money. He manage to encourage us to move higher that we did not have any income at all. Then they told us to attend mastermind here way go more money again travel to Los Cabos Mexico We are now Titanium. We are sack in more money.
they said to buy facebook page to Steve Bransfield $10k. And another coop tragic lead to Darren Salken $20k And now we are in Platinum.
We spent over$95k or more. Still did not make any $cent in our part. We already so brooked.
Again they have to teach us to get more money to the few more credit companies. So that we can buy more for the higher position Diamond. That is another $50k or so.
Then we went to sent Kitts again Matt and the other members told us to purchase more leads WCGT. Again another $20k or more. Plus our flights. It did horrible our retirement, Savings, and our house is back to re-mortgage.
I lost sleep until now a days. My husband 74 years old. He served in the Vietnam war. He wounded twice. We are both disabled.
He was looking to make some investment to make our life a little better. But yet we were sucked into the biggest SCAM business in the world.
So please help us to get our money back plus interest. All the credit card is so much interest. We are not able to dispute any credit card out there. No luck in our part yet.
It is about $200k or more than we spent on this scammer young man Matt Lloyd and his members.

I worked my butt off for nearly a year, as I was given breadcrumb after breadcrumb, waiting for it all to be revealed and for money to start coming in.
I went through all very long winded vague 21 steps and more and the only consistent thing was that money needed to go out!
No money ever came back, at approx $60k down I basically had s nervous breakdown as I could not see the way forward as the only answer I ever got from the coaches was if you keep going tweet this pay for that it will be fine!!
I pulled the plug and asked for my money back – there negotiations took forever and then after I agreed on when they offered it never happened and when I contacted them they told me that have been approved!!!
Utter sonofabitch…

Really – this man Matthew Lloyd “McThief” needs to be hanged – a death sentence, blunt and chilling in my words I may be, but there is absolutely no doubt – that Matt Lloyd, is as criminally bad in a financially fraudulent way – as a serial killer or anyone else who delves in ruining the lives of others – on such a HUGE scale.
I got into MOBE in 2015, and, ok – lost about $27000, but the credit card debts and interest were devastating – my house got remortgaged and I got into blacklisted credit ratings…..it is nothing but utter GARBAGE; what is more shocking is the sheer number of his utter GOONS who aggressively and callously got people, like myself, to the back of the room to totally scam us of our money, and borrow ridiculous credit – UTTERLY DISGUSTING.
For the last 3 years, I fought like crazy with my credit card companies….only for Matt’s pathetic disclaimers protecting a refund attempt (callous little shithead)…only once the FTC finally shut him down at last, did I engage in a war with my credit card companies (all my cards and accounts closed), and through sheer persistence, have recovered around $45000 (£30,000) from the overall scam.
My life has been in chaos since I was unfortunate enough to find this utter monster of a man Matt Lloyd – he even had the audacity to write TWICE with a carbon-copy letter to ‘Take a millionaire to lunch’ in his ‘Supercharge Summit invites’ – after I’d realised in 2015, it was all a big scam.
I even sat next to him at dinner in this pathetic event, with two other wealthy affiliates, and immediately noticed what a cold-eyed bastard he was; he just had this cold, cyborg-like personality – watching everyone in the room around him at the lunch table…
Fast forward to now, and the fact that one of the shamed 3 in the scam that got caught – Russell Whitney has died – well, I only hope he died a PIG and is rotting in hell, and hopes his ghost is not at rest….
The circle needs to close – Susan Zanghi is banned for life for promoting affiliate marketing opportunities…
Matt Lloyd is gonna lose this case, and, we will all have a barbecque when he goes down and gets 60 years in jail – hard time and losing his youth and dying behind bars – is what this motherfucka deserves..
Have to agree with you Ken; I don’t condone or encourage anything but I’m suprised nothing has been done to him or his family.
Where I’m from, him and his parents/siblings/children would all be 6 feet under years ago. Again, I don’t encourage that type of thing but it’s surprising they’re all still alive.
To this day, Matt Lloyd has absolutely no remorse for what all those lives that have been affected by him and his people. Not someone whom I ever want to deal with ever again.
I too am a victim of MOBE. I spent thousands on “guaranteed” traffic and sales only to be severely disappointed. Never again.
I have just recently filed bankruptcy due to my debts incurred with MOBE. Still makes me sick to my stomach.

I regret the day I agreed to throw caution to the wind and, against better judgement, invest in this scam.
Out of pocket for over $70,000 and hoping that some justice will be served when the FTC gets hold of his Monroe’s, properties, etc.
The wheels of justice may grind slowly but they do grind extremely fine.
I pity those who are unable to recover from this, those who have lost loved ones due to the hardship this person and his cohorts have scammed from the unsuspecting.
MOBE got me when I just got laid off from my job. I did the 21 step but I was leery of it from the start.
I invested about $2000 for some stupid videos that so-called teach you how to sell. the sad thing about it, they wanted me to invest more money!
Im like DAMN I just got laid off, collecting unemployment. One coach wanted me to go to the bank and take out a loan for $10000.
They were too aggressive so I just said…… I will put this on the back burner for now.
I stop answering the phone calls and emails. In my gut I knew it was a scam but they had sucked soooooo many people in.
I checked last summer and BOOM, MOBE was shut down by the FTC.
I really feel for the people that invested big money to this crab ass scam artist. He should be locked up for the rest of his life along with his coaches and crew/staff/etc.
I would like to know where he is hiding. But this pirate knew what was coming and I’m sure he has prepared since the beginning a way to escape with a big treasure. H
e talk about precious metals like gold and silver. I think he also have some properties, cars… Etc in some countries where you don’t have extradition laws with US and some place like Hong-Hong where you have the full secret and anonymous for your business and bank accounts.
He won’t travel anymore in many countries like US but anyway he don’t want because he have scammed so many people there and he will be in jail for 20 years at least.
I was a victim on MOBE as well.
They scammed me out of 12Gs They were very pushy when I stopped paying the $199 monthly fee. Hope I can recover my losses.
It is unfortunate that Matt Lloyd stole from so many people. I am a victim of his internet scheme and want my money back.
I invested over $2500.00 dollars and feel the commission should attempt to give something back to all who bought into scheme unknowingly.

I was scammed by Matt Lloyd and his minions. They are very good deceivers. I had just list my job due to illness and was unable to work in the capacity I had.
I was a Registered Nurse, Flight Attendant and cosmotologist. I had also been owner and manager of my open beauty shop and of a women’s health spa and weight loss spa.
My back was too bad to stand on my feet or exercise any longer. I had faith that I could do the program, and I could have, had it been a ligitamate business.
I was up all night most nights working very hard to make the program work. I lost approximately $45k.
I can’t believe how these people can act like they are interested in our lives and then stab us in the back as they have. They will reap what they have sewn.
Why is he still on the loose. He should have been arrested in 2018.
They let him start another business so the cycle starts again? The FCC is dragging their feet in this case.
It helps to know that I’m not alone in wasting my money on this scam but doesn’t make it any less painful.
Against my better, skeptical judgement I invested at the Platinum level. This only led to my “coach” (ha ha) telling me I needed to spend more money to buy leads from them none of which materialized.
Coach’s calendar was constantly booked (or so he made it appear) so getting a “coaching” session was nearly impossible. Overall, HUGE mistake.
I was also scammed by Matt Lloyd. It started with the 21 steps. Then the “coach” said in order to progress and make more money I needed to upgrade to the Silver/Gold step. Which was US2500.
I told her I couldn’t afford this and didn’t have that kind of money but she insisted that my success depended on how much I was willing to put into it and I should try to ask a family member if not a bank loan- which I eventually did.
This is double my currency, I now have over $5000.00 to pay and nothing to show for it.
Talking to me as if they really cared and wanted to help change my life around. I can’t belive I was sucked into this scam.
One thing she did shay before I advanced was the next “coach” will be trying to get me to upgrade again which would have cost US30,000. She knew it was a scam, knew I was struggling with 4 children ( I had given her my background) and yet heartless enough to encourage me to pay for something she knew too well didn’t exist.
I hope they all rot in hell.

Walmart doesn’t advertise an income opportunity to hide a pyramid scheme.
MOBE’s training was a sham, as evidenced by the majority of participants losing money – save for the few that were able to recruit (in true pyramid fashion).
Is there any way to get my money back? I disputed this through my credit card back when I first paid mobe.
I thought something wasn’t right so I tried to get a refund within the first 3 days but they won the dispute some how.
Mobe send some documents to my credit card company and I never got my money back.
When the time comes you’ll be able to file a claim.

If you’re already complaining about not getting your money back, probably best to forget about it and move on.
The claims process is slow and won’t go any faster, no matter how much you whinge and whine.
I think majority of people who fell for this (Scam) are your honest, hardworking 9-5 people who never dared to Educate them selves in business. The very people from the ‘E’ Quadrant if you read rich dad poor dad..
I feel bad for those who lost out money.. those who went in debt and are struggling.
