changes-worldwide-logoBack in September the US Commodities Futures Trading Commission (CFTC) filed a lawsuit against Timothy Baggett, Kimball Parker, Make Your Future, Changes Worldwide, and Changes Trading.

As per the lawsuit, the defendants stand accused of violating the Commodity Exchange Act. The CFTC are seeking ‘restitution, disgorgement, civil monetary penalties, a permanent trading ban, and such other equitable relief‘.

On September 27th a summons was issued to the defendants. All five defendants were subsequent served a copy of the summons.

To date none of the defendants have responded to the CFTC’s complaint.

On November 17th the CFTC filed for an entry of default against all five defendants.

On November 18th the clerk of the court partially granted and denied the CFTC’s motion.

An order of default was entered against Timothy Baggett, Kimball Parker and Make Your Future.

The clerk however denied an entry of default against Changes Worldwide and Changes Trading.

Changes Trading and Changes Worldwide were served on a co-resident at Timothy Baggett’s home.

There is no evidence to indicate that this individual is authorized to accept service on behalf of Defendants Changes Worldwide and
Changes Trading as required by Federal Rule of Civil Procedure 4(h)(1)(B).

Without more, the Clerk is unable to enter default against Changes Worldwide and Changes Trading at this time.

The clerk denied the motion with respect to Changes Trading and Changes Worldwide without prejudice.

The CFTC is now free to file for default judgment against Parker and Baggett, which is expected to take place in the coming weeks.
