Mind Capital’s David Kagel sentenced to 5 yrs probation
Mind Capital’s David Lee Kagel has been sentenced to five years probation.
The former securities law attorney will also have to pay back $13.9 million in restitution.
Mind Capital was an MLM Ponzi scheme that collapsed in August 2021.
In his capacity as an attorney, Kagel assisted accomplices David Gilbert Saffron and Vince Anthony Mazzotta with laundering Mind Capital investor funds.
Kagel pled guilty to conspiracy to commit commodity fraud back in May.
In the lead up to Kagel’s sentencing he underwent a sealed psychiatric evaluation. The evaluation was filed under seal as part of Kagel’s October 1st sentencing memorandum.
Sentencing via judgment was handed down against Kagel on October 7th.
Kagel is currently being held in a hospice care facility. Hospice care is typically for individuals suffering from serious illness who are approaching end of life.
Kagel has been restricted to his hospice care facility for the duration of his sentence. Whether Kagel will be subject to location monitoring is left to the discretion of his probation officer.
If Kagel doesn’t or can’t pay the ordered $13.9 million restitution amount within fifteen days from October 7th, interest kicks in as well as a $2500 fine.
The outcome of the Mind Capital criminal case against Saffron and Mazzotta remains pending. The pair are scheduled for trial in April 2025.
That reminds me, we haven’t heard from Simon Stepsys (big promoter of multiple scams, including Mind Capital) for quite a while. I wonder what he’s up to these days.
