BlackOxygen Organics cops $7.5 mill class-action judgment
BlackOxygen Organics and owner Marc Saint-Onge have copped a $7.5 million class-action default judgment.
BlackOxygen Organics was an MLM company Saint-Onge launched in 2015.
BlackOxygen Organics primarily marketed fulvic acid, sourced from a bog Saint-Onge owned up in Canada.
Saint-Onge’s bog sat adjacent a toxic waste processing facility. Given Black Oxygen Organics was selling fulvic acid for human consumption, product safety questions were raised.
Following a Canadian product recall citing “potential health risks” in October 2021, BlackOxygen Organics shut down a month later in November.
On November 19th, 2021, a class-action was filed against Black Oxygen Organics and Saint-Onge. The then proposed class-action, filed in Georgia, alleged toxicity related to BlackOxygen Organics’ products.
While BlackOxygen Organics publicly responded to the lawsuit back in 2021…
BlackOxygen has engaged legal counsel and it intends to vigorously contest the false allegations and, if appropriate, assert claims for damages against the responsible parties for defamation and damage to BlackOxygen’s reputation.
BlackOxygen is confident that it will prevail by presenting the true facts about BlackOxygen products and by proving that the allegations in the lawsuit are false and malicious.
…the company and Saint-Onge ultimately failed to defend the matter in court.
In an October 29th order granting default judgment against BlackOxygen Organics and Saint-Onge, the Georgia court wrote;
The defendants BlackOxygen Organics USA, Inc. and Marc Saint-Onge, having failed to plead or otherwise to defend in this action and default having been duly entered, and the Court, Leigh Martin May, United States District Judge, by order of October 28, 2024, having directed that judgment issue in favor of plaintiffs and against the defendants, it is hereby ORDERED AND ADJUDGED, that the plaintiffs Janice McMonigle, Amberly Ogden, Molly Sliwinski, and Lauren Wells recover from the defendants BlackOxygen Organics USA, Inc. and Marc Saint-Onge, the amount of $7,554,603.59 in damages.
The certified class includes any US consumers who purchased BlackOxygen Organics powered products from November 2019.
BehindMLM last came across Saint-Onge in July 2023, as the product formulator for Lovvare.
At launch Lovvare was fronted by CEO and former BlackOxygen Organics Master Distributor, John Altshuler.
Today there is no mention of Altshuler on Lovvare’s website. Instead Saint-Onge is presented as the company’s “founding formulator”.
As of October 2024, SimilarWeb tracked just 192 monthly visits to Lovvare’s website.
It is unclear what impact, if any, the BlackOxygen Organics default judgment might have on Lovvare’s business operations.
