Achieve Community SEC case on hold till further notice
On April 18th all parties involved in the SEC vs. Achieve Community civil case filed a joint motion to vacate the scheduled December 5th trial date.
Citing judicial efficiency, the motion requested the
court vacate the current trial date of December 5, 2016 in light of the ongoing criminal proceedings against Defendants Barnes and Johnson, which are expected to proceed to trial sometime in late 2016.
On April 20th Judge Blackburn granted the motion, ordering that the SEC’s civil action be administratively closed.
All scheduled dates in the matter were vacated, in addition to
the clerk of the court directed to close this civil action administratively, subject to reopening for good cause.
“Good cause” will likely see the case reopened once the criminal proceedings against Johnson and Barnes are concluded.
Kristi Johnson has plead guilty, however sentencing has been delayed pending the outcome of Troy Barnes’ criminal proceedings.
The latest on Barnes’ case is the criminal trial has been scheduled for the May, 2016 term. As at the time of publication no definitive trial date has been made public.

No, both are the subject of ongoing criminal proceedings.
The holdup is Barnes’ trial, which will kick off either this month or next.
Once Johnson and Barnes have sentenced the civil case will resume.
