TelexFree class-action denied class certification
The long-running TelexFree class-action has been denied class certification.
The April 8th decision is a massive stumbling block in the case, originally filed back in October 2014.
Plaintiff Anthony Cellucci sought to establish a class, consisting of
all persons that made a payment to TelexFree and suffered a [n]et loss … defined as placing more funds into TelexFree than the total fund withdrawn from TelexFree.
In denying class certification, the court examined issues with jurisdiction, and determination of damages (particularly with respect to separating net-winners from victims).
On April 22nd, Cellucci filed for a stay on proceedings, pending the outcome of a then yet to be filed appeal.
As at time of publication, the court has yet to rule on Cellucci’s request for a stay.
I failed to understand this brief but complicated legal jargon you publish!
I failed to understand your comment but I’m going to assume you’re thanking me for taking a complicated legal filing and simplifying it.
I get headaches from legal filings too sometimes.
Thank you for your education! Now does it mean all is lost especially if the appeal does not succeed?
Not sure what happens then other than the case proceeding as a class-action being over.
No idea what it means for the defendants that have already settled.
