The EminiFX Receivership has returned $76.8 million to Eddie Alexandre’s victims.

In a filed April 30th Status Report, the Receiver informed the court the EminiFX victim claim distribution will see “approximately $100,000,000” dispersed.

Looking forward, the Receiver will continue to make periodic payments to users from the Initial Distribution as such users’ claims become eligible and/or payment information is provided.

A number of EminiFX victims with approved claims have yet to provide payment details.

EminiFX founder Eddie Alexandre, currently serving a nine-year prison sentence after pleading guilty to fraud, continues to do his best to stall proceedings and stop victim restitution.

Since almost the beginning of the CFTC’s civil proceedings, every other week or so Alexandre files a motion objecting to something or demanding the entire case be stayed.

The court has routinely denied Alexandre’s, finding they are “lack legal authority”, are “meritless and untimely”. This prompts Alexandre to file endless appeals, which the court has stated are not “taken in good faith”.

Not sure when enough is enough but Alexandre has probably made ten to fifteen frivolous filings at this point.

Similarly we have Pierre Acluche, an EminiFX investor who claims to represent “several other EminiFX investors”. Acluche, who along with those he represents are assumed to be net-winners, sought intervene in the CFTC’s case (like Alexandre, they hope to stop victim restitution).

The court denied Acluche’s intervention motion, prompting an appeal.

In related news, the EminiFX Receiver has expanded the scope of a clawback lawsuit filed against Alexandre’s wife.

Back in March the Receiver initiated proceedings against Clarelle Dieuveuil, aka Marie Dieuveuil and Clarelle Alexandre.

In her capacity as EminiFX’s CFO, Dieuveuil is alleged to have played an integral role in EminiFX’s fraud.

On May 14th the Receiver filed an Amended Complaint, adding John Edvard Maisonneuve and Sophia Maisonneuve, aka Sophia Desrosiers, as defendants.

In a July 2023 report, the Haitian Times cites John Maisonneuve as “pastor of Shekinah Adventist Church in Allentown, Penn. and Bethlehem French Adventist Church in Reading, Penn.”

As alleged by the EminiFX Receiver;

According to investor claims, John Maisonneuve accepted large quantities of cash from Customers at one or both of the Seventh-day Adventists churches where he was a pastor.

John Maisonneuve received credits for cash collected from Customers in the amount of over $2.1 million by May 10, 2022.

Over $6 million total was collected in this way by the Maisonneuves and other collectors, but only approximately $1 million made its way into the EminiFX bank accounts that were turned over to the Receiver.

Maisonneuve’s wife, Sophia, is cited as “the backbone of the EminiFX Ponzi scheme. The EminiFX Receiver cites Sophie as EminiFX’s “National Senior Vice-President”.

The EminiFX Receiver claims Sophia Maisonneuve had an EminiFX investor account but didn’t invest any money.

Instead, she collected referral credits, sitting near the top of a multi-level marketing program at EminiFX that rewarded account holders for recruiting other Customers, akin to a pyramid scheme. She used so-called “withdrawals” from that account to extract over $300,000, and knew (or should have known) the true source of those funds—investor deposits.

She also received a separate $200,000 payment directly from EminiFX. There was no value provided to EminiFX in return; these payments were on top of the salary she was paid through payroll.
