Qyral to be dissolved, Receivership terminated
Following a November 2024 Status Conference, what’s left of Qyral has been ordered dissolved.
As per a January 7th, 2025 court order;
The Parties and the Receiver agreed to termination of the receiver’s duties with the exception of the attempted collection of funds by the Receiver from two Qyral service providers and filing his final accounting motion , dissolution of Qyral, dissolution of existing temporary restraining orders, and continuance of the existing motion for contempt filed by Sigari against Banasik.
Proof of Qyral’s California LLC being dissolved is required to be filed by January 31st. The Qyral Receivership will wind up by March 1st.
The previously granted Qyral TRO and preliminary injunctions are dissolved the date the order was filed.
The Parties’ existing motions for preliminary injunctions preceding entry of the Superseding TRO are hereby taken off calendar, as they are moot.
Neither of the Parties shall be entitled to any injunctive relief premised upon existing motions therefor.
The last remaining legal issue to resolve is Hanieh Sigari’s contempt proceedings against Darius Banasik.
At the November 22, 2024 status conference, Sigari and Qyral agreed to continue the trial on that application, pending the Parties’ settlement discussions and/or mediation in an ancillary marital dissolution case pending between Sigari and Banasik in the Superior Court of California, County of Santa Clara.
I’d not expect the contempt matter to go to trial. I’ll leave an update below on any further updates.
Update 28th March 2025 – The Qyral Receivership was terminated on March 25th.
On March 19th Hanieh Sigari filed an ex-parte motion requesting a TRO against Darius Banasik. The requested TRO pertained to alleged emails sent out in Sigari’s name by Banasik.
The emails, which Sigari claims could number in the thousands, were sent to Qyral promoters and customers to promote Banasik’s new company FancyMeds.
On March 21st the court ordered Banasik to stop sending “any emails, text messages or other communications from any Qyral Entity accounts”.
Regarding Sigari’s standing contempt proceedings, the court terminating the proceedings and vacated the pending September trial on March 27th.
Sigari has been given permission to file a new contempt motion, which the court will address at another hearing on April 1st.
Update 16th May 2025 – Hanieh Sigari has not filed a new contempt motion as at the time of this update.
A Joint Case Management Statement was filed on May 13th, with a Status Conference now scheduled for July 17th, 2025.
