Mirror Trading International’s South African liquidators have initiated clawback proceedings against top US net-winners.

Proceedings against US net-winners follows Chapter 15 recognition of South African liquidation proceedings by a Florida court in March 2023.

Unfortunately due to the size of each complaint and sheer number of individual filings, getting the amounts each net-winner has been sued for is cost prohibitive.

Summons filed on the net-winners have response deadlines beginning April 17th, 2024.

Cases are still being filed as of March 27th, so I suspect I’ll be updating this list with additional names till all US clawback cases have been filed.

In an April 8th Omnibus Motion, the MTI Liquidators state they have

filed approximately 150 adversary proceedings and anticipates that there may be as many as 50 more filings in the next several days.

Some Mirror Trading International US net-winners have also approached the Liquidators regarding potential settlement.

Several of the demand recipients have not (yet) been sued in adversary proceedings and a number of them have contacted counsel(s) for the purpose of exploring potential settlements with the Foreign Representative.

The Omnibus Motion also requests scheduling dates, and authorization to enter into settlements with US MTI net-winners who haven’t been sued yet.

The court has scheduled a hearing on the Omnibus Motion for May 2nd, 2024.

 

Update 6th July 2024 – The court approved the Omnibus Motion on May 9th. I don’t have any specific dates but this allows the MTI Liquidators to pursue and reach settlements with US net-winners without interference.

Separately MTI Liquidators additionally sued Carlos Alfredo Perez Haeussler ($27,510) and Chavonnes David Rosado on July 3rd.

 

Update 18th November 2024 – MTI Liquidators have additionally sued Michael Johnese-Preston and Xavier Karem Aponte.
