Rutherford v. Pruvit verdict held pending mediation
Following a three-day bench trial held in early February, the outcome of Michael Rutherford’s Pruvit lawsuit now hinges on mediation.
To that Keisha O’Neal and Pruvit appear to have already settled. Rutherford and Pruvit will enter mediation following appointment of a mediator on March 18th.
Keisha O’Neal filed a joint motion seeking dismissal of her case and Pruvit’s counterclaims on March 14th, the court approved the motion on March 19th.
I don’t know if this has anything to do with LaCore Enterprises selling Pruvit to Herbalife, as reported two days earlier on March 12th.
In any event if Rutherford and Pruvit can’t reach a resolution through mediation, the court will issue its withheld judgment from the bench trial.
This is an unusual turn of events in that I don’t recall seeing a judgment withheld like this before.
Looking forward, the court has ordered mediation between Rutherford and Pruvit take place before April 30th, 2025.
