Family First Life has settled a robocall fraud lawsuit filed against it in Indiana.

On June 12th Notice of a Settlement was filed on the case docket.

PLEASE TAKE NOTICE THAT … Plaintiff Aaron Rapp (“Plaintiff”); Defendants Integrity Marketing Group, LLC; Family First Life, LLC; Montalto United Insurance Agency, LLC; Third-Party Defendant Ryan Montalto; and Third-Party Defendant Donald Tuttle (“Defendants”) (collectively, the “Parties”) have reached a settlement in principle, which will fully resolve all claims by all Parties in the above-captioned case.

This was followed up by a filed stipulation to dismiss Rapp’s case with prejudice on July 19th.

Details of the settlement are not disclosed but it’s assumed there was a financial component to it.

Rapp sued Family First Life and parent company Integrity Marketing Group in August 2023. Rapp sought an injunction, statutory damages per alleged robocall fraud violation and court costs.

Since 2022 there have been seven robocall fraud lawsuits filed against Family First Life. Three have been settled (including Rapp), with the outcome of the other four cases pending.

Robocall fraud falls under the jurisdiction of the FCC. Whether there’s a federal investigation into Family First Life’s ongoing alleged robocall violations is unclear.

The Rapp settlement has to receive court approval before being finalized. I’ll leave an update note below when that happens.

 

Update 26th July 2024 – The court dismissed the case with prejudice on July 22nd, 2024.
