Following a hearing on December 7th, the Temporary Restraining Order My Advertising Pays had sought against VX Gateway has been denied.

VX Gateway had argued the Texas District Court didn’t have jurisdiction over VX Gateway or principals Celia Dunlop and Timothy MacKay. This appears to have been a sticking point, with jurisdictional discovery to take place until December 21st.

Discovery and depositions are for jurisdictional purposes and will focus on Defendants ties and activities in the United States or Texas.

A “second wave” of jurisdictional discovery will then take place until January 11th, 2017.

With respect to the main case, the court has set the following deadlines:

  • depositions to be complete by January 27th
  • motions to dismiss must be filed by January 31st, responses by February 14th and replies to responses by February 21st
  • response to the preliminary injunction motion by February 14th

While the TRO motion has been denied, My Advertising Pay’s preliminary injunction motion still stands.

In a nutshell, My Advertising Pays have been given additional time to source discovery that might strengthen their case.

The court has scheduled a preliminary injunction hearing for the 3rd of March.
